EVENT INFORMATION

QUINCEAÑERA PACKAGE - $3,000

• Full Day Coverage (8-10hrs) * Exceptions can be made on a case by case basis.

• 1 Photographer

• Pre Quinceañera Pictures - 50-100 fully edited high resolution photos

• Pictures Day of Quinceañera - 600-800+ fully edited high resolution photos

• Print Release

• 1 Videographer - Feature Film Documentary

TRAVEL

Quinceañera that requires travel by Samuel Gonzales Photographers will be determined by Samuel Gonzales Photography on a case-by-case basis and the fees and expenses associated with such travel will be agreed to as part of a custom price.

• A deposit of $1000, referred to as the retainer, is required to secure the booking for your Quinceañera. The retainer is non-refundable, except in circumstances where Samuel Gonzales, at his sole discretion, determines that a refund is warranted. Any such refund shall be considered on a case-by-case basis and must comply with applicable laws and regulations.

• The 2nd payment of $1000 is due on Dec 1st.

• The final payment of $1000 is due on the day of the Quinceañera.

• All payments are subject to any additional charges or modifications as outlined in this Agreement. Payments may be made at any time prior to the 30th day before the Quinceañera, subject to the terms herein.

CONTRACT TERMS

1. Agreement Overview

   1. This is a legally binding contract between Samuel Gonzales, doing business as "Samuel Gonzales Photography" ("Photographer/Videographer"), and the client stated above ("Client") for event photography and videography services. This Agreement supersedes all previous agreements, whether verbal or written. Any modifications to this Agreement must be made in writing and signed by all parties using the electronic signature platform provided by WIX. If any part of this Agreement is waived or altered, the remainder of the Agreement remains intact.

   
   

2. Services

   1. Client agrees to retain the event photography and videography services of the Photographer/Videographer for an event taking place on the date specified in this contract.

   
   

3. Exclusive Photography and Videography Services

   1. The Photographer/Videographer is the exclusive official photographer and videographer retained to perform the photographic and videographic services requested in this contract. No individuals other than Samuel Gonzales and designated staff are permitted to take images or video for profit-generating purposes. The Photographer/Videographer may substitute another competent professional photographer/videographer if necessary.

   
   

4. Cancellation Policy

   1. Cancellation or postponement of the event by the Client constitutes a breach of this contract.

   2. If the event is canceled or postponed by the Client with more than 60 days prior to the event, the non-refundable retainer payment will not be returned.

   3. If the event is canceled within 60 days of the event, the full amount is required and will be non-refundable.

   4. Cancellations and postponements must be made in writing.

      
      

5. Limitation of Liability and Refund Policy

   1. The Photographer/Videographer is not liable for damages or losses incurred during the event, except in cases where the Photographer/Videographer is at fault.The Photographer/Videographer is not liable for damages or losses incurred during the event, except in cases where the Photographer/Videographer is at fault.

   
   

6. Data Corruption Policy

   1. In the case of data corruption, the Photographer/Videographer will reimburse the Client only for the portion of the work lost.

   2. If 30% of the work was still delivered, the Photographer/Videographer will reimburse 70%.

   3. The pre-session is considered 30% of the work.

      
      

7. Photographer's and Videographer's Meal

   1. If the Photographer/Videographer is providing services longer than 5 hours, a warm meal must be provided with a 10-minute window for eating/refreshment.

      
      

8. Cooperation and Punctuality

   1. The Clients and the Photographer/Videographer agree to cooperate and communicate to achieve the best photographic and videographic results.

   2. Punctuality and cheerful cooperation are essential.

   3. The Clients will provide timely notification of key events to allow the Photographer/Videographer to prepare.

   4. The Clients understand that guests may take their own photos and videos but agree to prioritize the Photographer's/Videographer's work for required shots

      
      

9. Event Timing

   1. All contracts end at 10:00 PM.

   2. The Photographer/Videographer will begin wrapping up at 9:50 PM.

      
      

10. Team Members and Contracted Employees

    1. Services can be provided by a team member of Samuel Gonzales Photography or a contracted employee/s.

    
    

11. Force Majeure

    1. The Photographer/Videographer shall not be liable for any failure to perform its obligations under this Agreement if such failure is caused by events beyond the Photographer's/Videographer's reasonable control, including but not limited to acts of God, war, strikes, pandemics, government restrictions, and power failures.

    
    

12. Client Responsibilities

    1. The Client is responsible for ensuring that all necessary permits, permissions, and clearances are obtained for the Photographer/Videographer to perform their services at the event location. Any fees or costs associated with these permits or permissions are the responsibility of the Client.

13. Safety

    1. The Photographer/Videographer reserves the right to terminate coverage and leave the location of the event if the Photographer/Videographer experiences inappropriate, threatening, hostile, or offensive behavior from any person at the event, or in the event that the safety of the Photographer/Videographer is in question.

    
    

14. Indemnification

    1. The Client agrees to indemnify and hold harmless the Photographer/Videographer and its employees and agents from any and all claims, damages, losses, and expenses, including but not limited to attorney's fees, arising out of or resulting from the performance of the work described herein, provided that any such claim, damage, loss, or expense is attributable to bodily injury, sickness, disease, or death, or to injury to or destruction of tangible property, excluding data loss as covered under clause 6
